The Ministry of Health can allow a private clinic (Clinic) that meets the requirements to provide abortion services, after the decree determines the conditions that must be met in order for the doctor to carry out an abortion.

Ministerial order n°002/MoH/2019 of 08/04/2019 determines what must be observed in order for a doctor to inseminate a person, its fifth article.

It said that “Abortion is performed in a public or private medical center at the level of a hospital or polyclinic, which is authorized by the Minister of Health in his attributions.”

Currently, that article has been changed in the State Gazette n⁰ 50 of 9/12/2024

Ministerial Order No. 002/MoH/2024 dated 29/11/2024 amends Ministerial Order No. 002/MoH/2019 dated 08/04/2019 which determines the requirements for a doctor to carry out an abortion.

Its first article is about the medical center that is authorized to provide pregnancy services, it says that Article 5 of the Minister’s Order n° 002/MoH/2019 of 08/04/2019 determines what must be observed in order for a doctor to be pregnant. A person’s stomach is changed in the following way:

“Abortion is performed in a public or private medical facility authorized by the Ministry of Health to operate as a hospital, health center or polyclinic.

However, the Ministry of Health is responsible for allowing clinics that meet the requirements to provide abortion services, after reviewing the requirements.

It means that now the clinic that meets the requirements can be approved by the Ministry of Health, and perform an abortion for a person after evaluating the requirements, which is different from what was usual where polyclinics were only approved.

Ministerial order n°002/moh/2019 of 08/04/2019 determines what must be observed in order for a doctor to perform an abortion for the following reasons:

The first is that the person who is pregnant is a child, the second is that the person asking for the pregnancy was forced to have sex.

The third one is that the applicant had an abortion after being forcibly raped by a man and a woman.

Its seventh article states that before a doctor conceives a woman, she must give a thorough health consultation and perform a general examination.

A person applying for an abortion must indicate in writing that he consents to the abortion after being informed about all aspects of the abortion.

When the person applying for abortion is a child or a person with a mental disability, the legal representative is the one who indicates in writing that he consents to the abortion.

If the legal representative objects, the consent of the child shall prevail.

Statistics from the National Institute of Health, RBC, show that 4,378 women and girls were aborted between 2020 and 2023.

About 60% of abortions were carried out by force, 32% were at risk to the pregnancy or the child’s life, 3% were conceived as children, 2% were carried out by intimate partners, and 1% were carried out. and to whom they were forced.
